Your Rights as a California Home Seller
California law provides significant protections for homeowners selling their properties. Whether you're selling to an agent, listing on the MLS, or selling directly to a cash buyer, these rights apply to you.
Right to Full Disclosure
California requires sellers to complete a Transfer Disclosure Statement (TDS) disclosing all known material defects. Buyers (including cash buyers) must receive this document. However, when selling as-is to a cash buyer, the buyer typically waives inspection contingencies — they're accepting the property in its current condition with full knowledge of disclosed defects.
Right to Cancel
Under California law, you have the right to cancel a real estate purchase agreement under certain conditions. If you signed a contract at your home (not at the buyer's place of business), you have a 3-day right of rescission under the Home Solicitation Sales Act. Reputable cash buyers will clearly explain your cancellation rights before you sign anything.
Right to a Fair Price
There is no legal requirement to accept any particular price for your home. Cash buyers make offers based on market conditions and their renovation costs — you are always free to decline and pursue other options. Never feel pressured to accept an offer that doesn't work for you.
Protections Against Predatory Practices
California's Elder Financial Abuse laws provide additional protections for seniors. If you are 65 or older and feel you were pressured into a sale, contact the California Department of Real Estate (DRE) or a consumer protection attorney immediately.
Working with Licensed Buyers
